Personal Property- The subject of bailment that must be personal property, real property such as
land or building , cannot be bailed. Real property is leased under diffrent rules of law.
Acutual Bailments- bailees receive and accept the goods themselves.
Constructive Bailment- occurs when the balilee receives and accepts a symbol of the personal property.
Custody- having temporary control overy another personal property yet not have a bailment.
Fungible- there is now difference between one unit of the goods and another.
LEVELS OF CARE
Extraordinary care- means the bailee will be stricktly liable for any damage,loss or injury
to the goods.
Extaordinary bailment-is when goods are bailed with common carriers and hotels.
Gratuitous bailment- when only one of the parties benefits from the bailment.
Ordinary care-that the bailee will be liable if negligent in some way.
Mutual-Benefit Bailment-in which consideration is given and received.
Minimal care- means that the bailee must not ignore, waste or destroy the bailed property.
Involuntary Bailments- arises without the consent of the bailee.
